What is a Gift Deed / Relinquishment Deed / Partition Deed?
These three documents are the principal ways Indian families transfer or restructure ownership of property among relatives.
- Gift Deed: A document by which a donor transfers existing property voluntarily, with no consideration, to a donee, as defined under Section 122 of the Transfer of Property Act, 1882.
- Relinquishment Deed: A document by which one co-owner gives up or foregoes their share or right in a property in favour of another co-owner or relative, without receiving monetary consideration.
- Partition Deed: A document that divides joint family or co-owned property into separate shares, so each member holds their portion as an independent owner rather than as part of a common pool.
Key Clauses / What's Included
- Parties and Relationship: Full identification of donor and donee, or the cotenents and how they are related, as family transfers depend on the relationship between parties.
- Property Description: A precise description of the property being gifted, relinquished or partitioned, including boundaries, survey or khata details and extent of share.
- Consideration Clause: An express statement for a gift deed that the transfer is for no consideration (love and affection), which distinguishes it from a sale.
- Delivery and Acceptance: For a gift, evidence of transfer and the donee's acceptance of the gift, which are essential for a valid gift under Section 122 of the Act.
- Share and Division Schedule (Partition): A clear schedule specifying each party's share and, for physical partition, the portion each receives.
- Covenants, Maintenance and Taxes: Any rights of residence or maintenance retained, and the responsibility for stamp duty, registration and taxes.
Who Needs This / When to Use
A Gift Deed is used by a parent transferring a house to a child, an elder passing property to a grandchild without a sale, or a person gifting movable assets such as shares or jewellery. A Relinquishment Deed is used when a co-owner or legal heir gives up their right in favour of another, such as a brother giving up his share to a sister. A Partition Deed is needed when joint family property is being divided among heirs after succession or among co-owners who can no longer manage jointly. Each serves a different legal purpose, so choosing the right document matters.
How We Draft It
Our legal team drafts each document from templates grounded in the Transfer of Property Act, 1882 and the Indian Succession Act, 1925 (for heirs). You provide the parties, the property, the relationship and the intended outcome, and we prepare the correct document with clear clauses on consideration, acceptance, shares and taxes. We stress the registration requirement for immovable gifts, advise on stamp duty, and flag gift tax and income-tax implications where relevant, so the transfer is valid and undisputed.
For a partition, we also record the basis of division, including ancestral or self-acquired status, the consent of all adult co-owners, and the precise share of each member so that the deed settles the property once and for all rather than creating fresh disputes. Whichever document you need, we check the family relationship and the property records before finalising the draft.
FAQ
Is registration of a gift deed mandatory?
Yes. Under Section 123 of the Transfer of Property Act, 1882, a gift of immovable property must be made by a registered instrument and be accepted by the donee during the donor's lifetime to be valid. An unregistered gift deed does not transfer title. For movable property a gift may be made by delivery of possession or by a registered instrument.
What is the difference between a relinquishment and a gift deed?
A relinquishment deed involves a co-owner or heir giving up an existing share or right in favour of another person with whom there is a special relationship, usually without consideration. A gift deed transfers full ownership of property to any donee voluntarily. The choice depends on whether the person holds an existing right or is transferring property outright.
Can a gift be revoked after it is made?
Under Section 126 of the Transfer of Property Act, 1882, a valid gift that has been registered and accepted can be revoked only on the grounds given in the deed, such as breach of a condition by the donee, and a gift of immovable property cannot be revoked simply because the donor changes their mind. On the donor's death, a valid gift already operates and does not lapse back.
